Effe Een Spel (hereinafter: Kapitein Spel) processes personal data of customers and visitors of kapiteinspel.nl. In this privacy statement we explain which data we process, why we do so, how long we keep it and what rights you have. We handle your data with care and comply with the General Data Protection Regulation (GDPR).

Kapitein Spel is a trading name of Effe Een Spel, a general partnership (vennootschap onder firma). We are the controller for the processing of your personal data.

What data we process and why
Below, for each purpose, you can see which data we process and the legal basis under the GDPR on which we rely.
Processing your order
When you place an order, we process your name, delivery and billing address, email address and phone number. If you place a business order, you can choose to also give a company name. We use this data to process and deliver your order and to contact you about your order.

Payment
For payment, we process the data needed to complete the payment. The payment itself is handled by our payment provider. We do not store full payment details, such as your card number, ourselves.

Your account
You can create an account with us, but you do not have to. You can also order as a guest. If you create an account, we keep your details and order history so that you can easily find them later and do not have to fill them in again each time.

Invoicing and accounting
We process order and invoice data for our accounts. We are legally required to keep this data for a certain period.

Newsletter
If you sign up for our newsletter, we process your email address to send you our newsletter. You can unsubscribe at any time via the unsubscribe link at the bottom of every newsletter or by sending an email to hoi@kapiteinspel.nl. After you unsubscribe, we no longer send you our newsletter.

Emails that match what you view
We send our emails with Klaviyo. If you consent to marketing in the cookie notice, Klaviyo also sees which games you view on our website and add to your shopping basket. This lets us send emails that better match what you enjoy. Klaviyo only links this to you once you enter your email address with us or log in. If you do not consent, Klaviyo does not track anything on our website. You can withdraw your consent at any time via the cookie settings. You can read more about this in our Cookie policy.

Your order and shopping basket in Klaviyo
We send your order, and a shopping basket you do not check out, from our server to Klaviyo, also without cookies. This lets us email you about your order and about your shopping basket.

Reviews
You can leave a review of a product you bought from us. You can also leave a review of Kapitein Spel as a company via Trustpilot. For a product review, we process the details you fill in yourself, such as your name or screen name and your rating. Reviews via Trustpilot are handled by Trustpilot, which is itself responsible for that processing. Read their privacy statement for more information.

If you contact us, for example by email or phone, we process the details you give us to answer your question.

We process limited technical data to make our website work properly and securely and to prevent misuse.

Who we share your data with
We do not sell your data. We only share it with parties that help us provide our services. We have made agreements with these parties about careful and secure processing of your data (data processing agreements). Among others, we work with:
- Mollie, for handling payments
- Monta, for storing and shipping orders. For delivery, Monta uses carriers including DPD, UPS, DHL, PostNL and GLS
- Klaviyo, for our email marketing and newsletter
- Microsoft, for our business email and sending confirmation emails
- Algolia, for the search function on our website
- Google, for measuring website statistics and showing a map with our location
- Sevalla (Kinsta) and Upstash, for hosting and the technical operation of our website
We may also share data if we are legally required to, for example at the request of a competent authority.
Transfers outside the European Economic Area
Some of our partners are based outside the European Economic Area (EEA) or process data outside the EEA, for example in the United States. When that happens, we make sure your data stays properly protected. We do this based on a valid transfer mechanism, such as the EU-US Data Privacy Framework or the standard contractual clauses of the European Commission.
How long we keep your data
We do not keep your data longer than needed for the purposes for which we process it.
- Order and invoice data: 7 years, because of the legal tax retention obligation
- Account data: until you close your account
- Newsletter data: until you unsubscribe
- Data in Klaviyo about what you view, your shopping basket and your orders: until you unsubscribe, and at most 2 years after your last visit or order
- Correspondence with customer service: up to 2 years after your question has been resolved
- Reviews: as long as they are published
- Analytical data: up to 14 months
Your rights
Under the GDPR, you have the following rights:
- Right of access to your personal data
- Right to rectification of incorrect data
- Right to erasure of your data
- Right to restriction of processing
- Right to data portability
- Right to object to processing
- Right to withdraw your consent, if the processing is based on consent
You can make a request by sending an email to hoi@kapiteinspel.nl. We respond within the legal time limit. To verify your identity, we may ask you for additional information.
Automated decision-making
We do not make decisions about you based on automated processing that has significant effects on you.
Security
We take appropriate technical and organisational measures to protect your data against loss and unlawful processing.

Making a complaint
If you do not agree with how we handle your data, we would like to hear from you at hoi@kapiteinspel.nl. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
